The purpose of these General Terms and Conditions of Sale (GTCS) is to define the terms and conditions for registration, organisation and invoicing of training courses provided by the Groupe Institut de Genech. They apply to the following training courses: school curriculum (middle school, high school, excluding BTS), BTS school curriculum, apprenticeship training and continuing vocational training.<\/p>

These training courses constitute teaching services and associated services<\/strong> concluded between the Institut de Genech Group and the legal representatives of the pupil or student, or the adult learner. In accordance with Article L221-2 of the French Consumer Code, educational services related to schooling do not fall under consumer law applicable to the sale of goods.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1. Registration and formation of the contract<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Registration becomes final upon receipt of: the completed registration file, all requested documents, and payment of the registration fee.<\/p>

Signing the registration file constitutes acceptance of these General Terms and Conditions of Sale, the establishment's internal regulations, and the attached charters (IT charter, trust charter or equivalent).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2. Commitments of the establishment<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

The Institut de Genech undertakes to provide training for students for the duration of their studies or training programme. The institution delivers its teaching in accordance with:<\/p>

  • to the official qualification standards,<\/li>
  • to national programmes under the partnership agreement with the State,<\/li>
  • and the school\u2019s educational and pastoral programme.<\/li><\/ul>

    The teaching and educational teams are committed to welcoming every learner with a personalised support approach, educational monitoring, and a combination of educational care and high standards.<\/p>

    The institution also undertakes to inform the legal representatives or the learner of the progress of the schooling and to guarantee the exercise of parental rights in monitoring it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    3. Commitments of families or learners<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    The legal representatives or the adult learner undertake to:<\/p>

    • ensure the learner's attendance in accordance with statutory education requirements,<\/li>
    • respect the educational ethos of the school,<\/li>
    • to familiarise oneself with and comply with the rules of procedure and their annexes,<\/li>
    • to maintain collaboration with teaching and educational teams.<\/li><\/ul>

      They also undertake to monitor schooling on a regular basis (signing documents, attending meetings and interviews), to respect members of the educational community and not to make defamatory or violent remarks against them.<\/p>

      The legal representatives remain the the learner\u2019s first educators<\/strong> and play a part in supporting their academic and educational development.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      4. Contract term<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t\t\t\t\t

      The training or education agreement is entered into for a school year<\/strong> for school and BTS training courses, and for duration of the training course<\/strong> for apprenticeship programmes and continuing professional development.<\/p>

      It takes effect on the training start date and ends at the end of the school year or training course. The agreement may be renewed from year to year unless terminated by either party before its annual expiry date.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      5. Termination or cancellation of the contract<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t\t\t\t\t

      5.1 Termination during the course<\/strong><\/p>

      The training agreement may be terminated at the initiative of the institution or the family on the following grounds:<\/p>

      • relocation or change of establishment,<\/li>
      • academic or professional retraining,<\/li>
      • disciplinary exclusion,<\/li>
      • serious or repeated breaches of the internal rules or this contract,<\/li>
      • a re-examination of the school\u2019s educational and teaching approach.<\/li><\/ul>

        In the event of termination during the school year or training course, any month started is payable in full<\/strong>. In the event of termination for disciplinary reasons, the school may assist the family or the pupil in finding another school.<\/p>

        5.2 Cancellation before the start of the training course<\/strong><\/p>

        In the event of cancellation between the signing of the contract and the start date of the course, the registration fee and any deposits paid shall be retained by the institution as compensation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        6. Training and tuition fees<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        \n\t\t\t\t\t\t\t\t\t

        Depending on the training courses, the fees charged may include several categories.<\/p>

        6.1 School fees or educational charges<\/strong> \u2014 these fees cover in particular: teaching, educational, pastoral and administrative staff costs, management and operating costs, the maintenance of buildings and equipment, and educational costs not funded by the State.<\/p>

        6.2 Full board and half board<\/strong> \u2014 full board or half board constitutes a annual flat-rate package<\/strong> including: catering, premises maintenance, pastoral staff costs, and boarding or catering equipment.<\/p>

        6.3 Additional fees<\/strong> \u2014 certain fees may be provisioned or charged as a flat rate depending on the training course: photocopies and educational materials, school or professional insurance (particularly for work placements), access badges and student cards, small educational equipment and digital licences, class photos, branded clothing or professional equipment.<\/p>

        Regarding certain educational activities (visits, trips or educational projects), a provision may be included in the fees invoiced. An adjustment may be made at the end of the year depending on the expenditure actually incurred.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        7. Payment terms<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        Training or tuition fees are paid in accordance with the terms and conditions defined upon registration. Payments can be made by direct debit, or according to a payment schedule validated with the accounts department. In most cases, the direct debits are spread over ten monthly instalments starting from September<\/strong>.<\/p>

        In the event of unpaid balances not being settled after a written reminder, the file may be handed over to a debt collection agency. The corresponding costs will be borne by the family. However, the institution prefers to seek amicable solutions, notably through the implementation of tailored payment plans.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        8. Price review<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        In the event of any changes to tax, social security or health regulations having a direct impact on operating costs, the establishment reserves the right to revise its prices. This may notably concern a change in taxation or VAT, or a significant increase in costs linked to inflation.<\/p>

        Any price change is communicated to families within a reasonable timeframe before it applies.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        9. Absences and adjustments<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        Tuition fees cover the entire academic year, including periods of work experience, study trips, school holidays, e-learning days due to weather or other reasons, and teacher training days.<\/p>

        In the event of duly justified absence due to illness exceeding fifteen consecutive days, a flat-rate reduction may be applied to catering or boarding fees in accordance with the procedures laid down by the establishment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        10. Liability and damage<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        Any intentional damage to equipment (books, computer hardware, furniture, educational equipment, etc.) will be invoiced to the legal guardians or the learner based on the actual cost of repair or replacement.<\/p>

        Damage to or theft of personal equipment is the learner's responsibility and may be covered by their personal liability insurance.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        11. Assurance<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        Each family or learner must take out insurance covering: civil liability, accidents suffered or caused in the context of school or training activities, and journeys between home and the establishment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        12. Use of digital equipment<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        When the institution provides digital equipment (e.g. tablets or computer hardware), the learner undertakes to comply with the rules of use defined by the institution. A financial contribution may be required.<\/p>

        Any damage or loss may result in a financial contribution corresponding to the cost of repairing or replacing the equipment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        The personal data collected as part of registration and training monitoring are necessary for the administrative and educational management of the institution. They are processed in accordance with the regulations in force relating to the protection of personal data.<\/p>

        Data subjects have the right of access, rectification and objection.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        These Terms and Conditions of Sale are governed by French law. In the event of a dispute relating to their application, the parties shall endeavour to seek an amicable solution prior to any legal proceedings.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
