General conditions of use of the site and the services offered
Use of the association's website implies full and unreserved acceptance of the general conditions of use described below. These conditions of use may be modified or supplemented at any time, and users of the association's website are therefore invited to consult them on a regular basis. This site is normally accessible to users at all times. However, an interruption for reasons of technical maintenance may be decided by the association, which will then endeavour to communicate in advance to users the dates and times of the intervention.
The association's website is updated regularly by the association. Similarly, the legal notices may be modified at any time: they are nonetheless binding on the user, who is invited to refer to them as often as possible in order to familiarise themselves with them.
Description of the services provided
The purpose of the association's website is to provide information concerning all the company's activities. The association endeavours to provide information on the association's website that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies or shortcomings in updating, whether caused by itself or by third-party partners who provide it with this information.
All information provided on the association's website is for guidance only and is subject to change. Furthermore, the information appearing on the association's website is not exhaustive. It is provided subject to modifications that may have been made since it was put online.
Contractual limitations on technical data
The website cannot be held liable for material damage related to the use of the site. In addition, the user of the site undertakes to access the site using recent equipment, free from viruses and with an up-to-date, latest-generation browser.
Intellectual property and counterfeiting
The association owns the intellectual property rights or holds the usage rights on all the elements accessible on the site, including texts, images, graphics, logos, icons, sounds, and software.
Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited, except with the prior written authorisation of the association. Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the Intellectual Property Code.
Limitation of liability
The association cannot be held liable for direct and indirect damage caused to the user's equipment when accessing the Institut de Genech website, resulting either from the use of equipment that does not meet the specifications indicated in the previous point, or from the occurrence of a bug or incompatibility.
The association shall also not be held liable for indirect damages resulting from the use of the association's website.
Interactive features (such as the option to ask questions via the contact form or the chat function) are available to users. The association reserves the right to remove, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, the association also reserves the right to hold the user liable in civil and/or criminal proceedings, particularly in the event of messages of a racist, abusive, defamatory or pornographic nature, regardless of the medium used (text, photographs, etc.).
Personal data management
In France, personal data is protected in particular by Law No. 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the Criminal Code and the European Directive of 24 October 1995.
When using the association's website, the following may be collected: the URL of the links through which the user accessed the association's website, the user's access provider, and the user's Internet Protocol (IP) address.
In any event, the association collects personal information relating to the user solely for the purposes of certain services offered by the association’s website. The user provides this information in full knowledge of the facts, particularly when they enter it themselves. Users of the association’s website are then informed whether or not they are required to provide this information.
In accordance with the provisions of Articles 38 et seq. of Law No. 78-17 of 6 January 1978 on data processing, files and civil liberties, all users have the right to access, rectify and object to the processing of their personal data by submitting a written and signed request, accompanied by a copy of an identity document bearing the holder’s signature, specifying the address to which the reply is to be sent.
No personal information of the site user of the association is published without the user's knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the assumption of the buyout of the association and its rights would allow the transmission of the aforementioned information to the potential purchaser who would in turn be bound by the same obligation of data storage and modification with respect to the site user.
As a registered association, the Institut de Genech is exempt from the requirement to register with the CNIL. The databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
Hyperlinks and cookies
The association's website contains a number of hyperlinks to other sites, set up with the authorisation of the association. However, the association is unable to verify the content of the sites thus visited, and consequently assumes no responsibility for this.
Browsing the association's website may result in the installation of cookie(s) on the user's computer. A cookie is a small file which does not allow the user to be identified, but which records information relating to a computer's browsing on a website. The data thus obtained are intended to facilitate subsequent browsing on the site, and are also designed to enable various traffic measurements.

Governing law and jurisdiction
Any dispute relating to the use of the association's website is subject to French law. Exclusive jurisdiction is granted to the competent courts.
